Riassunto Riassunto A livello Comunitario il quadro normativo delle acque destinate al consumo umano ha subito recentemente sostanziali cambiamenti. A decorrere dal 25/12/2003 la Direttiva 80/778/CEE è stata abrogata dalla 98/83/CE, recepita in Italia con D.Lgs. 31/2001 che riconosce, come principio ispiratore, l’osservanza di una base legislativa comune a tutti gli stati membri lasciando agli stessi la discrezionalità di introdurre valori parametrici secondari. La direttiva prevede che i valori parametrici introdotti debbano essere rispettati fino all’erogazione dell’acqua, facendo rientrare nel campo della responsabilità l’utilizzatore finale sia esso responsabile di esercizio pubblico che utente privato. La normativa getta le basi per una vera e propria rivoluzione
culturale e coinvolge tutte le componenti istituzionali, politiche e tecniche del territorio
nell’ottica della tutela di un patrimonio che “appartiene alle generazioni future” e che quindi va tutelato.

Summary EU legislative framework on water for human consumption has recently been
deeply modified. As from 25 December 2003, the Directive 80/778/EEC has been abrogated by the Directive 98/83/EC, transposed into the Italian legislation with the law 31/2001, which establishes as an inspiring principle the observance of laws common to all Member States while leaving them the discretion to introduce secondary parametric values. The directive provides that the parametric values should be respected until water distribution, by making the final user fall into the sphere of responsibility as a responsible of either a public commercial concern or a privately-run concern. This piece of legislation lays the foundation for an actual cultural revolution and the involvement of all the institutional, political and technical components of the territory, the aim being to safeguard a property that “belongs to future generations” and, thus, to be protected.

Résumé Le cadre normatif communautaire sur les eaux destinées à la consommation
humaine a subi récemment de substantielles modifications. À partir du 25 décembre 2003, la Directive 80/778/CEE a été abrogée par la Directive 98/83/CE, mise en vigueur en Italie avec la loi 31/2001, qui reconnaît comme principe inspirateur l’observation d’une base législative commune à tous les États Membres, tout en laissant aux mêmes le pouvoir discretionnaire d’introduire des valeurs paramétriques secondaires. La directive prévoit que ces valeurs paramétriques doivent être respectées jusqu’à la distribution de l’eau, en introduisant la responsabilité de l’usager final qu’il soit le responsable d’un lieu public ou privé. Cette directive pose les jalons d’une véritable révolution culturelle e d’une implication de toutes les composantes institutionnelles, politiques et techniques du térritoire, dans l’optique de la sauvegarde d’un patrimoine qui “appartient aux générations futures” et qui, donc, doit être protégé.

Zusammenfassung Im Rahmen der Europäischen Gemeinschaft wurden kürzlich wichtige Veränderungen im Bezug auf die Richtlinien für Trinkwasser eingeführt. Ab dem 25/12/2003 ist die Richtlinie 80/778/Cee nicht mehr gültig, an ihre Stelle tritt die 98/83/Ce, in Italien durch das Gesetz D.I.gs 31/2001 ausgedrückt, das die Befolgung einer für alle Länder der Gemeinschaft gültigen gesetzlichen Basis anerkennt, aber allen Ländern die Möglichkeit gibt, sekundäre Parameter anzuwenden. Die Rchtlinie sieht vor, daß die eingeführten Parameter nur für die eigentliche Wasserversorgung gültig sind, während die Verantwortlichkeit dem Endverbraucher, ob für einen öffentlichen Betrieb oder als privater Endverbraucher, zusteht. Die Richtlinie legt die Grundlage einer wirklichen kulturellen Rivolution, in die alle institutionellen politischen und technischen Komponenten des Landes einbezogen werden, im Sinne der “Wahrung eines Vermögens, auch der zukünftigen Generation” und die folglich geschützt werden muß.
